What these terms cover
These terms govern your use of this website and any order you place through it. At present that means sample orders.
Flooring, wall and ceiling boards, herringbone and stair components are supplied by quotation rather than bought through this website. Those supplies are governed by our Terms of Trade. Where a supply is made under a quotation, the Terms of Trade apply and these terms do not.
By using this site or placing an order, you accept these terms. You need to be 18 or over to place an order, or to have the consent of a parent or guardian.
Samples
Samples are free and unlimited within New Zealand, and we mean it. Order as many as you need, and order again when the light in the room changes your mind.
We send samples to Australia, Europe, North America and parts of Asia at a flat rate of NZ$32 per order. Any duties or taxes payable on arrival are yours. Orders are charged in New Zealand dollars wherever they are sent.
We may limit, decline or cancel a sample order where we believe the request is not genuine, is automated, or is being made at a scale the programme was not intended for. We would rather say that plainly than quietly stop sending samples.
A sample is a guide, not a guarantee of an exact match. It shows the colour, grain and finish of the board it was cut from. Because oak is a natural material, the floor delivered to your project will vary from the sample in tone, grain and texture, and will keep changing with light exposure across its life. That variation is not a fault. It is the reason we send samples free and unlimited, and the reason we ask you to live with them in the actual room before you specify.
Prices
Retail prices displayed on this website include GST. Prices quoted separately under our Terms of Trade exclude GST, which is payable in addition.
Prices may change without notice. The price that applies is the one shown when your order is confirmed.
We may correct administrative, clerical or typographical errors at any time, including errors in pricing, order confirmations or invoicing. Where a correction materially increases the price of something you have ordered, you may cancel that order without penalty.
Orders and payment
Placing an order is an offer to buy rather than a completed contract. We may accept or decline it. Your order is accepted when we confirm dispatch.
Payment is processed by Shopify. We do not see or store your full card details.
Delivery, returns and faults
Delivery is covered in our Shipping policy. Returns and faults are covered in our Refund policy. In short: samples are free within New Zealand, risk passes when goods leave us with the carrier, and delivery dates are estimates.
Your rights under New Zealand law
If you are a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply, and nothing in these terms limits or excludes your rights under them.
If you acquire goods in trade, for the purposes of a business, our Terms of Trade apply instead. Under those terms the parties agree that the Consumer Guarantees Act does not apply, and that sections 9, 12A and 13 of the Fair Trading Act do not apply.
Technical information on this site
We publish test results, specification guides, installation instructions and compliance documentation because we would rather you read the report than take our word for it.
That material is provided to assist your designer, architect or engineer. It is not a compliance certification. You are responsible for ensuring that the selection, installation and use of our materials complies with the New Zealand Building Code, all relevant standards, and any consent or regulatory requirements.
We supply materials only. We do not install. Any installer we recommend is an independent third party, and we are not responsible for their work, advice or services.
Advice given by us, on this site or in person, is given in good faith and without liability.
Copyright and use of this site
The text, photography, drawings and design on this site belong to Marchand Limited, or to the photographers and studios credited alongside them. You may not reproduce, republish or use them commercially without our written consent.
Project photography is published with the permission of the owners, architects, designers and photographers credited. Please do not reuse it.
You are welcome to use this site for your own project research, and to share links to it.
Booking and third-party services
Design consultations are booked through a third-party scheduling service. Your use of that service is subject to its own terms and privacy policy.
Availability
We do our best to keep this site running and accurate. We do not guarantee uninterrupted access, or that every detail is free of error at every moment.
Privacy
How we handle personal information is set out in our Privacy policy, in accordance with the Privacy Act 2020.
Liability
To the extent permitted by law, and without limiting the rights of consumers under the Consumer Guarantees Act, we are not liable for indirect or consequential loss, including loss of profit, loss of contract, delay, liquidated damages, or the cost of removing, refinishing or reinstating other work. Our total liability in connection with any supply is limited to the price paid for the goods giving rise to the claim.
Changes to these terms
We may update these terms. The version published here when you place an order is the one that applies to it.
Governing law
These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.
